The subject premises consists of two residential buildings, both 12 storeys in building height with two underground parking levels. The buildings were constructed in 1963 and contained 106 and 140 units respectively. Life Safety Studies were completed on the buildings in October 1995 for a variety of issues with respect to Section 9.6 of the Ontario Fire Code. Some of these included fire separations in suites, exits, mechanical rooms, milk boxes and refuse rooms, smoke control, access to exits, exit signs, emergency lighting, fire alarm and detection system and an elevator for firefighters’ use. After review, the fire department approved the Life Safety Studies, contingent upon some amendments, but did not approve the schedule of completion for the work.
The owner did not feel that the previous time frame for completing the work was sufficient, due to numerous meetings and discussions with the fire department that delayed completion of the work. The owner also wanted some consideration in the extent of the work required, due to the possibility that the buildings may be demolished in the near future.
The Commission granted an extension to December 31, 1996 for all work to
be completed. The Commission also accepted the alternative to require
sealing of the milk boxes by use of a screw through the door to secure the
door in the closed position. The Commission did not feel that potential
future demolition was sufficient justification for delaying retrofit
implementation and thereby subjecting the occupants to unacceptable life
safety.
