Fire Code Commission Decision Summary

SUBJECT MATTER:

The subject building is three storeys in height with a basement, and is constructed with a combination of combustible and non-combustible materials. The building contains one residential unit in the basement, three units on the main floor, four units on the second floor and four units on the third floor. This building falls under Section 9.5 of the Ontario Fire Code and should have been brought into compliance prior to October 9, 1994. A total of 11 items dealing with suite separation, exit separation, exit signs and lighting, emergency lights and fire alarm systems were identified as not complying with Retrofit provisions of the Fire Code. A number of time extensions were granted by the fire department between October 1994 and July 1995. The last extension granted allowed for an extension to January 1996 if the fire alarm system was installed immediately. When this was not complied with, the last request for an extension was denied. An informal review conducted by the OFM restricted compliance dates to October 9, 1995.

REASON FOR APPEAL:

The owner stated that he delayed in complying with Retrofit because he was negotiating with a non-profit organization for purchase of the building. Since these negotiations had not been successful and he was experiencing economic difficulties, he required an extension.

COMMISSION'S DECISION:

The Commission accepted the timeline of January 1, 1996 for compliance, as previously discussed between the fire department and the owner. In view of the progress achieved by the owner with respect to the fire alarm system and suite separation, it appeared reasonable to accept the extension of time agreement.
