Fire Code Commission Decision Summary

SUBJECT MATTER:

The subject premises is an outdoor storage site approximately 1.12 acres, triangular in shape. A 3800 square foot, one storey building of concrete block construction, with unrated flat roof construction is located on this site. The building is constructed of cinder block walls with an unrated flat roof of combustible construction. There is a natural gas hook-up to the building. Tires are stored to the west and north of the building and bundles of tires are stored inside the building. It is estimated that there are between 90,000 and 120,000 tires on site. The tire pile is essentially one large mass extending past the property boundary at the northeast side by 24 feet. Drainage from the property is towards a lake located about 1200 feet to the east, with a slope consisting of a drop of 2 feet in 50 feet. Only about 5% of the property is fenced and no other security measures are provided. The adjoining properties are commercial or residential, with a nursing home within 1500 feet. The fire department requested authorization from the Commission to clear the site of all tires and therefore eliminate the hazard and the environmental impact.

REASON FOR APPEAL:

The owner is unable to finance elimination of the hazard and has requested the assistance of the city and the fire department.

COMMISSION'S DECISION:

The Commission granted the fire department authorization to clear all tires from the site by September 29, 1995 under the provision that the transfer and disposal of the tire would be in accordance with applicable environmental regulatory requirements. The city was also given the option of placing security on the site until the site was clear of tires.
