SUBJECT MATTER:
Order to Pay Costs of a fire watch provided at the premises.
GENERAL DESCRIPTION OF PREMISES:
The building has three storeys and is a of combustible construction. The premise is a low rise residential apartment house with eleven rooms, ten living quarters and one commercial. At the time of inspection, approximately fifteen people occupied this building.
REASON FOR APPEAL:
Exercising right of appeal under Section 18.5(1) pursuant to Section 18.3 of the Fire Marshals Act.
APPELLANT'S POSITION:
Does not feel that a fire watch was warranted and therefore should not have to pay the costs.
RESPONDENT'S POSITION:
An inspection revealed defects in the electrical installation, no test of the building fire alarm system had been conducted and various smoke alarms were not functional. These conditions were found to present an immediate threat to life and therefore, a fire watch was posted.
COMMISSION RULING:
The Order to Pay Costs No. 93/062 was upheld and the costs were found to be reasonable.
REASONS:
The condition of the property at the time of the inspection justified the posting of a fire watch in order to provide for an appropriate level of life and fire safety for the occupants and the property.
