Effective January 1, 2009, amendments to Regulation 950 (R.R.O. 1990),
Proceedings Commenced by Certificate of Offence, came into effect. The
amendments involve revisions to the “Certificate of Offence”, “Offence Notice”
and “Summons” forms. The Ministry of the Attorney General has provided a
six-month transition period, until June 30, 2009, to allow enforcement agencies
to begin using the revised forms.
Fire services are advised to obtain and begin using the new forms as soon as
possible. As of July 1, 2009, the older forms will be invalid. Enforcement
agencies will continue to obtain paper ticket books and sequential numbers for
e-ticketing systems from their local municipal Provincial Offences Act court
office.

The revised forms are shown in Regulation 950, which is posted on the e-Laws Web site at www.e laws.gov.on.ca. Replicas of the “Certificate of Offence” form and the “Offence Notice” form are attached. Please note that, depending on the jurisdiction of the fire department, the back of the “Offence Notice” form may vary with respect to the defendant’s options.
The Office of the Fire Marshal (OFM) is in the process of revising technical guideline OFM-TG-01-2006, Commencing Proceedings Under Part I of the Provincial Offences Act, to reflect the amendments to Regulation 950.
