Intent: |
This Article is intended to ensure that the manufacture, storage, transportation and sale of fireworks in the Province of Ontario be regulated by the Explosives Act (Canada) and the Explosives Regulation enacted by this act. |

| Q1 | Does the fire department have authority to enforce local fireworks regulations (i.e. municipal by-laws) that are stricter than Provincial Regulations? | |
| A1 | Subsection 23-(2) of the Fire Marshals Act allows a municipality to pass by-laws that have more exacting requirements for keeping and manufacturing of explosives than what is required by Subsection 5.2.2. of the Fire Code. The by-laws may not set stricter requirements than the Explosives Act (Canada) and the Explosives Regulations under this Act, but they may have additional requirements regarding details of storage and handling. The fire department would be empowered to enforce these by-laws.

| A2 | the Explosives Act and the Explosives Regulations are administered by Natural Resources Canada (Explosives Branch). Thus, all inquiries should be directed to this body, with the contact person being the Senior Inspector, Ontario Region at (613) 995-8439. Inquiries on testing of fireworks etc. should be directed to the Explosives Research Laboratory at (613) 995-0097. The most recent edition of the Explosives Act and the Explosives Regulations should always be consulted. |
